Policy: Marihuana Law and Sworn Employees


The purpose of this policy is to address recent legal changes in Michigan for the use, possession or cultivation of marihuana.


It shall be the policy of the Michigan State University Police Department (Department) to be compliant with state and federal laws concerning the possession, use or cultivation of marihuana.


Recent Legal Changes

The Michigan Regulation and Taxation of Marihuana Act took effect on December 6, 2018, allowing for the recreational use of marihuana by persons 21 and older.

Departmental Impact

Marihuana use remains illegal under federal law (Controlled Substances Act, Drug-Free Workplace Act, Drug-Free Schools and Communities Act, and Gun Control Act).

Sworn Department members are prohibited from:

Using marihuana either on-duty or off-duty

Cultivating marihuana

Possessing marihuana (except as required to perform their authorized duties under law and Department policy)

Sworn Department members who violate the law or Department policy related to marihuana will be subject to discipline.
